The National Jewish Advocacy Center (NJAC) has urged the U.S. Department of Justice to investigate whether New York City is failing to provide Jewish residents with equal protection under the law amid a dramatic rise in antisemitic attacks.
In a formal legal filing submitted to the Justice Department’s Civil Rights Division, NJAC requests a federal “pattern-or-practice” investigation into whether New York City and the NYPD are denying Jewish New Yorkers equal protection by failing to adequately respond to what it describes as a “documented and severe wave of antisemitic violence.”
According to the filing, Jewish New Yorkers accounted for 57 percent of all reported hate crime victims in 2025, despite making up only about 10 percent of the city’s population, and the city’s response “runs in the opposite direction from the data,” the filing states.
NJAC argues that Mayor Zohran Mamdani’s decisions and words have contributed to discrimination against Jews.
NJAC also notes that Mamdani’s decision to revoke its adoption of the International Holocaust Remembrance Alliance (IHRA) working definition of antisemitism and decline to adopt another formal definition has weakened efforts to combat anti-Jewish hatred.
As the filing states: “A government that declines to recognize the most common form the hatred now takes has declined, in advance, to police it.”
The organization is asking the Justice Department to investigate whether the city has systematically underprotected Jewish residents, require disclosure of enforcement data related to antisemitic hate crimes, and determine whether New York City is complying with federal civil rights law.
The Justice Department has the authority to investigate whether a government entity has engaged in a pattern or practice of violating constitutional or federal civil rights protections. NJAC argues that the evidence warrants such an investigation.

I respectfully urge the Department of Justice to carefully review the National Jewish Advocacy Center’s request for a pattern-or-practice investigation into Mayor Zohrani and New York City’s response to antisemitic hate crimes.
According to NJAC’s filing, Jewish New Yorkers have been the victims of a disproportionate share of hate crimes, yet serious questions remain about whether these crimes are being investigated and prosecuted with the same level of commitment afforded to other communities.
Every American deserves equal protection under the law, regardless of religion or ancestry. If there is evidence that Jewish New Yorkers are not receiving that protection, the Department of Justice should conduct a thorough and impartial investigation.
I respectfully ask the Civil Rights Division to review the evidence presented by NJAC, determine whether a pattern or practice of unequal protection exists, and take whatever action is appropriate to ensure that the civil rights of Jewish New Yorkers are fully protected.
